Your rights if detained or arrested

Right to habeas corpus

Section 10(c) of the Canadian Charter of Rights and Freedoms says:

Everyone has the right on arrest or detention “to have the validity of the detention determined by way of habeas corpus and to be released if the detention is not lawful.”

Section 10(c) of the Canadian Charter of Rights and Freedoms provides that if you are detained or arrested, you have the right to be brought quickly before a court of law to determine if the arrest or detention is lawful—and to be released if it is not lawful.
