De plus, votre consentement doit \u00eatre \u00e9clair\u00e9 et volontaire, ce qui signifie que vous devez disposer de suffisamment d\u2019informations pour prendre une d\u00e9cision \u00e9clair\u00e9e, et que vous ne devez pas avoir \u00e9t\u00e9 priv\u00e9 de votre choix en le donnant.<\/p>\n<p>En g\u00e9n\u00e9ral, un consentement valable ne peut \u00eatre donn\u00e9 que par vous-m\u00eame et non par une autre personne en votre nom.<\/p>\n<p>Dans certaines situations, des policiers ont essay\u00e9 de faire valoir que le fait qu\u2019une personne ne s\u2019oppose pas \u00e0 voix haute \u00e0 la fouille signifie qu\u2019elle y consent. Par exemple, si un agent de police vous demande de lui remettre votre sac ou de lui montrer ce que vous avez dans vos poches et si vous faites ce qu\u2019il vous dit sans rien dire, la police a parfois essay\u00e9 de faire valoir qu\u2019elle avait votre consentement parce que vous l\u2019avez accept\u00e9 et que n\u2019avez pas dit \u00ab\u202fnon.\u202f\u00bb<\/p>\n<p>Les organismes de d\u00e9fense des droits comme l\u2019ACLC estiment qu\u2019il n\u2019y a de <strong>v\u00e9ritable consentement<\/strong> que si vous avez r\u00e9ellement accept\u00e9. Si vous n\u2019avez rien dit \u00e0 la police ou si vous avez suivi ses instructions \u2013 et si la v\u00e9ritable raison de cette attitude \u00e9tait que vous ne vous sentiez pas libre de dire non, que vous vous sentiez intimid\u00e9 ou inquiet de ce que les agents pourraient vous faire, ou que vous pensiez que la loi vous obligeait \u00e0 suivre les instructions de l\u2019agent de police \u2013 <strong>nous ferions valoir qu\u2019il ne s\u2019agit pas d\u2019un v\u00e9ritable consentement<\/strong>.
